Situated in a quiet and private countryside setting, this immaculate 4 bedroom villa is ideal as a holiday home, for tourist rentals and equally good for permanent living.

In a mountain setting above Malaga, located on a ridge and just a short drive from the country town of Colmenar, this delightful property has only a short track to reach it, possible in most ordinary vehicles, and a driveway leading up to a parking area behind the house.

At the moment the platform on which the house stands is not landscaped or made into gardens, but could be make into beautiful gardens, covering an area of around 1,000m2. The rest of the plot drops down the hillside, with olive and almond trees, ensuring uninterrupted views, but it is possible still to create terraced areas for growing fruit trees and ornamental plants, if wanted. There is also space to create a lower platform on which an above ground pool could be added, that would be flush with the ground on the top level.

The front door leads through a covered porch area into the hallway (2.5 x 3m). From here, to the right, a door leads into the living room (7 x 4.5m), a lovely bright, light room with a wood-burner fireplace for cosy winter evenings. Open plan to the living room is the large, oak fitted kitchen (4 x 3.5m) with granite work-tops, with a side door leading to an open terrace outside, which, being on the north side of the house, is shaded in the middle of the day and therefore an ideal outdoor spot to enjoy in the hotter summer months. The kitchen has space for a double American-style fridge/freezer and is fitted with an osmosis inverter for the purest drinking water. Back in the hallway, straight ahead is the family bathroom (3.5 x 2m) and to the left a short corridor leads to bedroom 1 (3.5 x 3.5m), bedroom 2 (3 x 3.5m), bedroom 3, (also 3 x 3.5m), and bedroom 4, the master bedroom which in total is around 5.5 x 4.5m including an en-suite bathroom of 3.5 x 2m.

This spacious, comfortable house, all on one level, has mains electricity and water, a 2000L spare water tank, 3-phase electricity, hot/cold air conditioning in the living room and master bedroom, electric heating panels on the walls and a sensor light in the entrance. There is also a store/laundry room with plumbing for a washing machine. There is an excellent hot water boiler and a water purifier.

A wonderful property for family enjoyment, or as a tourist rental, in a magnificent setting.

Buying a Property in Spain

1. Putting down a Holding Deposit

On finding a property you wish to purchase you will need to negotiate the terms, price and conditions of the sale with the owner. This part of the process is not binding. We would recommend using an independent English speaking legal advisor. Once a purchase price has been agreed, normally a holding or reserve deposit will be required to ensure the property is removed from the market. The sum required will vary between properties and will be based on the purchase price. A time limit for the preagreement to be signed will be arranged and there will also be legal checks to be made.

2. Setting up a Pre-agreement (Contrato privado de compraventa)

The pre-agreement will set out the conditions under which the Buyer and Seller agree to complete the purchase of the property and the price they have agreed upon. Relevant details will generally be included for example the property details, purchase price and the date for completion. A deposit will be required at this point, this will vary, but will generally be 10% of the agreed price. This agreement will include a penal clause if the sale does not go through. If the seller pulls out of the sale your compensation will be double the deposit you have paid, but if you decide not to go through with the sale then your deposit will be lost. Certain checks will need to be made before signing the contract, checks should be made against the title of the property, mortgage status and if the property has any debts held against it. The planning status should also be looked into. These conditions can be varied by the seller and the buyer and other types of agreement can be made.

3. The Contract (Escritura de compraventa)

Before a non-Spanish purchaser can buy a Spanish property they will need to have set up a Spanish bank account and obtained a Spanish tax number (NIE). The completion will take place in the presence of a Notary Public. This is a Spanish public official, by law the deed of sale must be witnessed by a Notary Public. You will also need your own independent, expert legal advisor to act on your behalf. On Completion the buyer must pay the balance, that is the price agreed after the deposit has been deducted, plus any other fees on the completion date. Both buyer and seller must sign the Escritura de compraventa contract, (this is the Spanish equivalent of the title deeds). The title deeds (escritura) will be given to the buyer, this will be done in the presence of a Notary Public, they will certify that the transfer has taken place. The tax office will be sent a copy and the property registry will be informed of the transfer.
