Benajarafe is a lovely area on the coast about 20 minutes east of Malaga city, with almost a village atmosphere, and with one of the most beautiful beaches in the Costa del Sol and plenty of amenities. It is extremely popular with tourists.
Located in a peaceful, residential area just a few minutes walk up the hill from the beach, in Benajarafe, this is an impressive home on 3 floors, with gardens and a heated indoor pool.
Ground level: large garage with electric doors and large storage area beyond which houses the equipment for the central heating system, which is powered by oil, and heats the entire house, water and pool. There is also an off-street parking space by the house. From here, a gate leads into the fully fenced property, with a paved area at ground level and steps leading up both to the pool level, and to the upper floor.
On pool level, there are very large glass sliding doors to the pool area itself, meaning that the indoor pool area is open to the outside too, keeping it cool in the summer. A door to one side leads into the self catering lower level apartment, on pool level. This consists of a fully equipped kitchen/dining/living room (4 x 4m) with a wide arch leading into a beautiful double bedroom (4 x 3m) with beautiful built-in wardrobes. A door beyond the living area leads to a bathroom/sauna area, with a separate WC, and a short corridor area of 2 x 2m leading to the sauna and walk-in shower. There are also stairs here connecting this floor to the upper floor. A glass door from here also leads into the pool area. The pool area is around 70m2 in a L-shape, with a pool of 8 x 3m and a relaxation area, with a large open walk-in shower plus a door to a huge bathroom (10m2). Its floor-to ceiling glass doors means that the pool area can be opened up to the outside. The pool area has electric condensation extractors.
Next door, accessed via a side door, is a separate mini unit, consisting of a living room (5 x 3m) and a wide opening to a double bedroom (4 x 3m). The living room area has a huge picture window to the outside which could easily be replaced with double doors, for direct access from outside and a kitchenette area could be added to this room. Also, the large, 10m2 bathroom in the pool area is next to the bedroom and it would be easy to open a door through the shared dividing wall to make this bathroom an en-suite for this bedroom. As the bathroom is large, it could even be divided into 2, to convert it into a main pool bathroom, plus an en-suite bathroom for the bedroom.
The stairs lead to the upper floor, and into an inner hallway. At the far end is a double bedroom (4 x 3m) with built-in wardrobes and a large en-suite bathroom (3 x 3m) with double wash basin, walk-in shower and corner bath. Back in the hallway, next to the stairs, is the 4th bedroom, currently fitted with a single bed, although a double bed is possible, or possibly this room would work well with bunk beds (4 x 2.5m). Opposite this bedroom and the stairs, on the opposite side of the hallway, are two doors - one to a WC and the other to a small store room. It is also perfectly possible to remove the partition wall between them and convert this into a family bathroom. Beyond, past the main entrance from outside, into the living room, a light, bright room (5 x 5m) with large sliding double doors out to a large terrace and a corner fireplace. A wide arch leads into the kitchen (5 x 3m) which is fully fitted with quality kitchen units, and has a glass door out into the garden.
The terrace has a large covered area, and is peaceful and beautiful, ideal for outside dining and living and there is a glimpse of the Mediterranean through the leafy trees. The garden continues beyond the terrace, with steps leading down to the lower outdoor areas. The garden wraps around the rear and far side of the house. Here there are plenty of tropical plants and trees and a magnificent fig tree with its wide leaves offering shade in the summer. Around the far corner, past a 'nispero' tree, is a lovely lookout area which has high seats and a 'bar' top, ideal for an evening glass of wine or a sip of champagne.
This delightful house is in excellent condition. It has central heating, hot and cold air conditioning in all rooms, a working fireplace for the winter, mains drainage, mains water and mains electricity, plus internet. The house is alarmed. The heated indoor pool means that the pool can be enjoyed at all times of year.
This is a perfect investment opportunity, as it would work very well as a holiday home, potentially bringing a return on investment in around 10 years.

Buying a Property in Spain
1. Putting down a Holding Deposit
On finding a property you wish to purchase you will need to negotiate the terms, price and conditions of the sale with the owner. This part of the process is not binding. We would recommend using an independent English speaking legal advisor. Once a purchase price has been agreed, normally a holding or reserve deposit will be required to ensure the property is removed from the market. The sum required will vary between properties and will be based on the purchase price. A time limit for the preagreement to be signed will be arranged and there will also be legal checks to be made.
2. Setting up a Pre-agreement (Contrato privado de compraventa)
The pre-agreement will set out the conditions under which the Buyer and Seller agree to complete the purchase of the property and the price they have agreed upon. Relevant details will generally be included for example the property details, purchase price and the date for completion. A deposit will be required at this point, this will vary, but will generally be 10% of the agreed price. This agreement will include a penal clause if the sale does not go through. If the seller pulls out of the sale your compensation will be double the deposit you have paid, but if you decide not to go through with the sale then your deposit will be lost. Certain checks will need to be made before signing the contract, checks should be made against the title of the property, mortgage status and if the property has any debts held against it. The planning status should also be looked into. These conditions can be varied by the seller and the buyer and other types of agreement can be made.
3. The Contract (Escritura de compraventa)
Before a non-Spanish purchaser can buy a Spanish property they will need to have set up a Spanish bank account and obtained a Spanish tax number (NIE). The completion will take place in the presence of a Notary Public. This is a Spanish public official, by law the deed of sale must be witnessed by a Notary Public. You will also need your own independent, expert legal advisor to act on your behalf. On Completion the buyer must pay the balance, that is the price agreed after the deposit has been deducted, plus any other fees on the completion date. Both buyer and seller must sign the Escritura de compraventa contract, (this is the Spanish equivalent of the title deeds). The title deeds (escritura) will be given to the buyer, this will be done in the presence of a Notary Public, they will certify that the transfer has taken place. The tax office will be sent a copy and the property registry will be informed of the transfer.
